Welcome to Flopsy, an educational platform operated by Odd Solutions Ltd ("we," "us," or "our"), designed to teach users about the mathematics of poker. By accessing or using Flopsy ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be of legal gambling age in your country of residence to use Flopsy. By using the Service, you confirm that you meet this requirement. The Service is not intended for users below the age of 18, even if local gambling laws allow younger ages.

2. Account Creation and Security

• Users must create an account to access the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Account sharing is strictly prohibited.
• We reserve the right to suspend or terminate accounts suspected of unauthorized use, account sharing, or other violations of these Terms.

3. Payment Terms

• The Service operates on a monthly subscription basis through Stripe. Payment methods accepted by Stripe (e.g., credit card, PayPal) are supported.
• All payments are non-refundable, except under special circumstances as determined by us at our sole discretion. If you believe you are owed a refund, contact us at josh@flopsy.io.
• Subscription fees may increase annually in line with inflation or if sales tax requirements apply. We will notify you in advance of any price changes.

4. Prohibited Activities

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service for any illegal or unauthorized purpose.
• Share account credentials with others.
• Attempt to download or duplicate the Service's intellectual property.
• Engage in any activity that disrupts or interferes with the Service.

5. Intellectual Property

You may not copy, distribute, modify, or resell any content from the Service without explicit permission from us.

6. Content Accuracy Disclaimer

Flopsy provides educational content related to the mathematics of poker. While we strive to ensure the accuracy of this content, we make no guarantees and disclaim any liability for inaccuracies, errors, or omissions.

You agree that:

• The educational content is for informational purposes only and does not constitute professional advice.
• We are not responsible for any financial losses or damages resulting from the use of the Service or reliance on its content.

7. Limitation of Liability

To the fullest extent permitted by law:

• Odd Solutions Ltd is not liable for any indirect, incidental, consequential, or special damages, including financial losses resulting from gambling activities, to the fullest extent permitted by applicable law.
• Our total liability for claims related to the Service will not exceed the amount you paid to use the Service in the 12 months preceding the claim.

8. Indemnity

You agree to indemnify and hold harmless Odd Solutions Ltd and its affiliates, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. These Terms may also be updated periodically. Continued use of the Service after updates constitutes acceptance of the revised Terms.

11. Transfer of Ownership

In the event that Odd Solutions Ltd, or Flopsy as a standalone service, is acquired by or merged with another entity, we reserve the right to transfer all user data, including personal information, to the new owner as part of the transfer of assets. If the new owner is not bound by these Terms, you will be notified and given the opportunity to cancel your subscription.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Odd Solutions Ltd regarding the use of Flopsy and supersede any prior agreements.
